The Louisiana Department of Public Safety and Corrections applied for the seizure of a motor vehicle under La.R.S. 32:651, et seq. The owner of the vehicle objected. A hearing was held and the trial court upheld the seizure and owner's counsel was granted ten days to file a devolutive appeal. We granted writs and now affirm.
On August 23, 1995, defendant, Katrina Cook, was arrested for driving while intoxicated and submitted to a breath test which indicated an alcohol level of.10 percent. She was charged with driving while intoxicated. On October 9, 1995, the Department of Public Safety and Corrections submitted an application for the seizure of her motor vehicle pursuant to La.R.S. 32:651, et seq. The deputy sheriff was notified and went to Cook's home to seize her vehicle. Defendant's counsel was notified. A hearing was held on November 8, 1995, and the vehicle was seized. On November 16, 1995, defendant filed an opposition to the application and a counter application for the return of the vehicle.
La.R.S. 32:651(A) provides:
"Except as provided by Subsection D of this Section, a law enforcement officer of this state may seize and impound a vehicle if he has probable cause to believe that it is in violation of any provision of this Chapter or any ordinance of any parish of this state. If the owner of a vehicle is not in possession of a driver's license and has not been issued an operator's license, the law enforcement officer shall, in addition to any notice he may have, give the owner of the vehicle written notice of the time, place and date of the hearing to contest the seizure and impoundment of the vehicle.
